In this context, it is worth noting that the Criminal Code has an article providing for penalties for abuse of the emblem and flag of Russia. In particular, under Article 329 of the Criminal Code, acts of this nature is punishable by restriction of liberty for a term up to one year, or community service for the same term, or imprisonment for up to six months.
Since the national anthem, along with the flag and coat of arms, also considered the state symbol of Russia, and abuse of them requires a criminal rather than administrative responsibility, as reflected in current legislation. Therefore, Nath said that the amendments to the Criminal Code, and should correct this injustice.
