No smoking coal: The court quashed the resolution. What now? – Interia

Although the judgment of the court in Krakow is preparing for the introduction of the smoking ban coal. Yesterday, the Provincial Administrative Court quashed the resolution of Malopolska voivodship parliament, which introduces non-smoking coal to heat homes and apartments.

Court held that the ban violates the constitutional principle of equality, the rule of law and economic freedom. In addition, the resolution does not specify exactly whom it is addressed. According to the court, the introduction of the smoking ban coal may also threaten the energy security of the country.

– It’s crap, crap and crap again – says Wojciech Kozak and stresses that the resolution applies only to the city of Krakow. – Do not violate Polish potential, which is coal. The resolution challenged two the Kraków. One called for stricter rules and extend the ban on burning wood in fireplaces. The second applicant considered that the provisions strike the interests of the poorest of Krakow who heat homes and apartment cheap coal.

The new law had come into force in 2018.
