Media: for the State again offered not to punish the Russians for personal self-defense – RIA Novosti

MOSCOW, October 6 – RIA Novosti. The vice-speaker of the State Duma Igor Lebedev (LDPR) is developing a bill to amend the limits of personal self-defense, which proposes to significantly expand the rights of Russians until the destruction of the offender, the newspaper “Izvestiya “Monday.

In April, the proposal to adopt such a law has gained 100,000 votes on the site” Russian public initiative “(roi.ru) and the procedure was referred to the experts who approved the initiative and sent to the federal government . However, representatives of the Ministry of Justice and the Interior Ministry did not support the project. Earlier, similar initiatives Senator Eugene Tarlo and deputy Alexei Zhuravlev also received negative reviews.

“This time we use modern technology to place text document on the portal, see the pros, cons and wishes and will make in the autumn session in Duma “- the newspaper quoted Lebedev.

Vice Speaker proposes to exempt citizens from the responsibility for the murder of criminals breaking into their house.

” It would be appropriate to introduce the concept of the Russian legislation ” My home – my castle. “If a citizen defends his own house, his own family, himself, uses weapons against bandit zalezshego in his house, it should not be punished with the punishment,” – said Lebedev.

Now the Russian Criminal Code does not consider the crime of murder or bodily injury, committed in “self-defense” – that is for protection against socially dangerous assault, “violent, life-threatening defendant or another person, or an immediate threat of such violence” (Article 37) .

Exceeding the limits of self-defense – that is, intentional acts, is clearly not consistent with the nature and dangers of abuse – is punishable by law: up to two years in prison for the murder of up to a year for causing a serious or moderate bodily injury (Article 108 and 114). In 2003, an amendment was adopted that is not considered to be in excess of self-defense situation where the defender could not objectively assess the danger of attack.
