Armed Forces of the Russian Federation upheld the posthumous prosecution of Magnitsky – RBC

The Russian Supreme Court upheld a posthumous prosecution of Hermitage Capital lawyer Sergei Magnitsky. This was reported in the press service of the Foundation, RIA Novosti reported.

The judge refused to submit to the cassation appeal filed by the lawyer in the interests of the mother of the deceased Natalia Magnitsky.

In early October, the Investigation Committee RF for the fourth time refused to renew the investigation into the death of Magnitsky. The petition also served to protect the mother Magnitsky.

Sergei Magnitsky died during the investigation in the “Sailor’s silence,” November 16, 2009. He headed the department of tax and audit firm Firestone Duncan, provides legal services, including fund Hermitage Capital Management. Magnitsky was accused, together with five other defendants he allegedly organized illegal refund of overpaid income tax for 2006, stealing from the budget of 5.409 billion rubles. At the same time, according to lawyers fund Magnitsky uncovered billions of dollars in the scheme of theft from the Russian budget, in particular the case of compensation from the budget “overpaid” amounts of taxes in the amount of 5.4 billion rubles.
